E-store terms of use

1. General terms

1.1. The online store of Denim Dream sells products (hereinafter referred to as the Products) sold at the stores owned by Põldma Kaubanduse AS.

1.2. The conditions apply to the legal relationships  that arise between the customer (hereinafter referred to as the Customer) and Põldma Kaubanduse AS (hereinafter referred to as the Seller) as the owner of the shopping environment located on the website www.denimdream.com (hereinafter referred to as the Online Store) when Products are bought from the online store. In addition to these conditions, the  legal relationships that arise when Products are bought from the Online Store are also regulated by the  legislation of the Republic of Estonia.

1.4. All pictures and texts shown on www.denimdream.com are protected by Law of Copyright. All rights reserved by Põldma Kaubanduse AS. Using any data without permission is not allowed.

2. Prices

2.1. All prices displayed in the Online Store are given in euros and include VAT.

3. Products

3.1. Usually, the Products displayed in the Online Store are in stock. The  availability of the said Products is not guaranteed, since  it can be erroneous due topossible technical problems in the  Online Store’s programmes.

3.2. If the Customer places an order but it appears that the given Product  is out of stock, the Online Store cannot execute that order. In this case, an employee of the Online Store will refund money  for the purchase.

3.3. The photos displayed of the Products in the Online Store are  illustrative and may differ from the actual appearance of the Product to a small extent.

4. Making a purchase

4.1. The Customer selects a desired Product from the Online  Store and adds  it to the shopping cart by clicking on the button “ADD TO BAG”.

4.2. To place the order, the Customer must click on the button “CHECKOUT”, after which the Customer is forwarded to the order placement page. After entering the required data, the Customer will pay for the product through an internet bank link  and confirm the order by clicking on the button “Return to Merchant”.

4.3. When the Customer has paid for the Product, the Online Store will send a confirmation to the Customer’s e-mail address.

4.4. The Customer is obligated to provide necessary and correct information when the order is placed.

4.5. The Seller takes no responsibility for not being able to execute the order or any consequences that arise due to incorrect information given by the Customer during the placement of the order.

4.6. The Seller has the right to refuse to fill the order if there is a doubt the data presented to the Seller is incorrect or if the conduct is not in accordance with good practice.

5. Methods of payment

5.1. The Customer can pay for their orders with credit cards (Visa and MasterCard).

5.2. The payment is carried out outside the online store of Denim Dream in a secure paying environment of service provider Maksekeskus AS (http://maksekeskus.ee/en/).

5.3. The Seller does not have access to the Customer’s bank or credit card information.

6. Denim Family loyalty program in the online shop

6.1. Loyal customers who have registered and logged in earn 5% bonus money from their purchase price after completing the purchase.

6.2. Bonus money that has been accrued can be used to get a discount on the next purchase.

6.3. Bonus money can be used to pay for up to 30% of the total payable sum.

6.4. Bonus money can be earned and used with products sold for full price as well as with those that are on sale.

6.5. Bonus money is not earned from transportation costs.

6.6. Bonus money accrued within one calendar year will expire on March 31 of the next calendar year.

6.7. When an order is cancelled, the customer will be refunded the bonus money used when placing the order and the seller will be refunded the bonus money the customer earned with this order.  If there is not enough bonus money on the customer’s account, the balance of the bonus money will become negative.

6.8. If the customer has paid for transport and not all of the transportation costs are refundable, the amount paid for transportation will be first deduced from the bonus money used and only then, if necessary, will it be deduced from the sum actually paid.

6.9. 3 days prior to and 3 days after their birthday, a loyal customer has the right to get 10% discount on products sold for full prices. Bonus money is not earned from these purchases. Bonus money accrued can be used with the birthday discount.

7. Delivery

7.1. From our EU e-store page we ship to European union countries: Austria, Belgium, Bulgaria, Spain, Netherlands, Croatia, Ireland, Italy, Greece, Cypros, Luxembourg, Malta, Poland, Portugal, France, Sweden, Romania, Germany, Slovakia, Slovenia, Finland,  United Kingdom, Denmark, Czech Republic, Hungary.

7.2. Delivery time  is 10 working days.

7.3. The package will be delivered to address given by the Customer. Courier will contact the Customer before delivery to agree with suitable delivey time. If courier can not reach Customer, order is taken to post office. The Product is kept at the post office for 14 calendar days. If the Customer does not collect the Product within the term specified, they are obligated to compensate the costs of repeated shipping.

7.4. The Customer is obligated to check the correctness of their contact information before placing their order to avoid delays and misunderstandings when the Products are delivered. The Seller takes no responsibility for delays and misunderstandings upon delivery if the delay or misunderstanding arises from incorrect information given by the Customer during the placement of the order.

7.5. If the Product does not arrive in good condition and in closed packaging, the Customer is obligated to notify the Online Store, sending a corresponding e-mail to epood@denimdream.ee or calling +372 5556 3459.

8. Exchanges and returns of the Products

8.1. The Customer has the right to exchange or return their ordered Product within 14 days. The 14 day term starts from receiving the order from courier or post office.

8.2. When return will arrive at the Online Store, Store will send a confirmation to the Customer’s e-mail address about having received the product.

8.3. The Seller will not cover the delivery costs of returns.

8.4. In the case of an exchange, the Online Store will send a new Product to the Customer immediately after receiving the Product that is to be exchanged.

8.5. The Product can only be exchanged for another size of the same product.

8.6. The Seller shall refund the purchase price of the Product within 14 days as of the timely arrival of the Product at the Online Store. The money is refunded to the same bank account from which the Customer paid for the corresponding order. If the Customer used bonus money to pay for the Order, used bonus money shall be returned to the Customer and earned bonus money shall be removed.

8.7. In the case of refunding the purchase price, the Seller will not compensate the cost of transport service related to this purchase.

8.8. In the case of returns or exchanges, the Customer is obligated to fill out the exchange and return form that came with the Product and send it to the Online Store with the products that are to be exchanged or returned.
An exchange or return is only accepted if it is accompanied by a filled out return form.

8.9. The Product that is to be replaced or returned cannot be damaged or have signs of having been worn, it must be in its original packaging and all original tags must be attached to the product.

8.10. Underwear and opened cosmetics and perfume packages cannot be returned.

8.11. The Customer is obligated to open the Product packaging carefully without damaging it. If it is not possible to open the package without damaging it, the Product does not have to be in its original packaging when it is returned.

9. Claims procedure

9.1. Pursuant to subsection 2 (218) of the Law of Obligations Act, a two-year term for raising claims applies to the Products sold at the Online Store. Any disputes between the Customer and the Seller shall be solved by negotiations.

9.2. Pursuant to subsection 1 (222) of the Law of Obligations Act, the Customer has the right to demand the repair of the Product or delivery of a replacement Product if it does not conform to the contract. If the Product does not conform to the contract, the Seller shall cover all the costs related to repairing or replacing the Product, above all transportation, shipping, work, travel and material costs.

9.3. The Seller takes no responsibility for damages arising from the abnormal use of the products or for delays if they are due to circumstances the Seller could not affect and/or are conditioned by force majeure.

10. Liability

10.1. The Seller and Customer shall be liable to each other for the damage caused by violating these terms of use in the cases and to the extent provided by the legislation valid in the Republic of Estonia.

10.2. The Seller is liable to the extent of the purchase price.

10.3. The Customer is obligated to use the service of the Online Store only for purposes that are legal and in accordance with good practice.

11. Privacy policy

11.1. The Customer gives the Seller a clear and informed consent for processing their personal data.

11.2. The personal data given to the Seller shall be entered into the customer registry and will be used for providing sales service and offering products to the Customer.

11.3 The Seller stores the contact information and information about the purchases entered by the Customer during purchases. This information will be handled as confidential and is processed in accordance with the Personal Data Protection Act. The personal data necessary for delivery will be forwarded to a business providing courier service.

11.4. The Seller may only use the Customer’s personal data for sending information about special offers and campaigns to the Customer’s e-mail address if the Customer has given their consent.

11.5. Data exchange between the Customer and card payment centres is encrypted, ensuring the safety of the Customer’s personal data and bank information. The payment is carried out outside the online store of Denim Dream in a secure paying environment of the corresponding bank or service provider. The Online Store does not have access to the Customer’s bank or credit card information.

12. Terms of use and their alteration

12.1. Upon signing up or making a purchase, the Customer accepts the terms of use of the Online Store and is obligated to follow them.

12.2. The contract of sale between the Seller and Customer enters into force after the purchase price is transferred to the Seller’s bank account.

12.3. The Seller has the right to alter the terms of use and prices of the products of the Online Store. A notification about the changes made shall be published in the Online Store environment. The conditions and prices valid at the time of the transaction shall be applied to the transaction.

12.4. The Seller has the right to disclaim the execution of the order when the displayed price in the Online Store is incorrect due to a technical error.

13. Other conditions

13.1. Any disputes between the Customer and the Seller shall be solved by negotiations.

13.1. If the Seller has refused to solve the Consumer’s complaint or the Consumer is not satisfied with the solutions offered by the Seller and finds that his or her rights have been violated or interests damaged, the Consumer may submit a claim to the Consumer Protection and Technical Regulatory Authority Committee through the Consumer Protection Board or to a court. The Consumer can contact the Consumer Protection and Technical Regulatory Authority free of charge and the value of the transaction in question must exceed 20 Euros. The Consumer may file the claim directly or through a representative. The contact details of the Consumer Protection and Technical Regulatory Authority are provided on the website of the Consumer Protection and Technical Regulatory Authority; for settling of claims arising in the EU Member States, the European Consumer Centre should be contacted.
